PRIVACY POLICY FOR PRIVATE PAGES

Kelly Registration Systems, Inc.’s (herein, “Company”) online transaction processing service, available at http://www.kellysolutions.com (herein, the “Website”) and accessible only with a username/license number and password issued by the applicable state agency or other entity, allows its users to submit data and any applicable fees to multiple state agencies and other entities (collectively, the “Service”).  The Website contains web pages that are available without a username/license number and password (“Public Pages”) and web pages that are available only with a username/license number and password issued by the applicable state agency or other entity (“Private Pages”).  This Privacy Policy applies only to your use of the Private Pages.  The Privacy Policy for the Public Pages can be found on the Website at http://www.kellysolutions.com/privacy.asp.

 

1.                  Information Company Collects.

(a)    Company collects information from you when you access or otherwise use the Service to perform any of the following tasks online, which tasks are collectively referred to as “Online Offerings”: (i) submit secure and verifiable document(s) to state agencies and other entities (herein, “Document Submission”); (ii) apply for various license(s), permit(s) and certification(s) (herein, “License Registration”); (iii) renew various license(s), permit(s) and certification(s) (herein, “License Renewal”); (iv) register various products (herein, “Product Registration”); (v) renew various product registration(s) (herein, “Product Registration Renewal”); (vi) submit tonnage reports to state agencies and other entities (herein, “Tonnage Report Submission”); or (vii) pay invoices for certain services received from state agencies and other entities (“Invoice Payment”).  The information Company collects from you, which information is collectively referred to as “Information”, includes, but is not necessarily limited to, the following:

                                                  i.      Your name;

                                                ii.      Your mailing address;

                                              iii.      Your physical address;

                                              iv.      Your telephone number;

                                                v.      Your e-mail address; and,

                                              vi.      The data you provide that is required by a particular state agency or other entity for each Online Offering you request (herein, “Data”).

(b)   You may, however, visit the Public Pages of the Website anonymously.

 

2.                  Changing Your Information.

(a)    You are assigned a username/license number and password by the state agency or other entity.  The assignment of your username/license number and password creates your account with the Company (the, “Account”).  You are able to access your Account on the Website by entering that username/license number and password.  For some license types, you can review and change your Information at any time by using a function called “Update Your Own Information” available on the Website and following the instructions there.

 

3.                  How Company Uses Your Information.

(a)    Any of the Information Company collects from you may be used in one of the following ways:

                                                  i.      To personalize your experience;

                                                ii.      To improve the Website;

                                              iii.      To improve the Service;

                                              iv.      To improve customer service;

                                                v.      To perform the Online Offerings you request; and

                                              vi.      To send periodic e-mails to you (e.g., to notify you that a state agency or other entity is ready for your License Renewal, Product Registration Renewal or Tonnage Report Submission).

Note: You will need to contact the state agency or other entity directly to have your e-mail address removed from the database.

 

4.                  Use of Tracking Software.

(a)    Company does not use tracking software, such as “cookies.”

 

5.                  How Company Protects Your Information.

(a)    Company implements a variety of security measures to maintain the safety of your Information.  In particular, Company uses firewalls that are designed to protect your Account from unauthorized access.  Nonetheless, you are solely responsible for any access of your Account by any person or entity, including the payment of any fees incurred on the Account, regardless of whether such access was authorized by you.  Also, Company uses a cryptographic (digital certificate) key to secure Data and payment information (e.g., credit card number, bank account number, etc.) sent between your browser and Company’s server.  Whenever you use the Service, Company’s server responds to your transmission by sending this key that is authenticated by your browser.  This key encrypts the Data and payment information sent by you, and Company decrypts the Data and payment information when Company receives it.

 

6.                  Disclosure of Information to Outside Parties.

(a)    Except as provided in Section (6)(b), Company does not sell, rent, trade or otherwise disclose to outside parties your personally-identifiable Information without your permission.  This does not include trusted third parties who assist Company in operating the Website, conducting Company’s business or servicing you, so long as those parties agree to keep this Information confidential.

(b)   Company may release your Information when it believes release is appropriate to comply with the law, enforce its Website policies, or protect the rights, property or safety of itself or others.

(c)    Notwithstanding the foregoing, non-personally identifiable Information may be provided to other parties for marketing, advertising or other uses (e.g., evaluating Website usage by analyzing user information in the aggregate).

 

7.                  Third Party Links.

(a)    Occasionally, at its discretion, Company may include other third party products or services on the Website.  These third party sites have separate and independent privacy policies.  Company therefore has no responsibility or liability for the content and activities of these linked sites.  Nonetheless, Company seeks to protect the integrity of the Website and welcomes any feedback about these third party sites.

 

8.                  Online Privacy Policy Only.

(a)    This Privacy Policy applies only to Information collected through the Website and not to information collected offline.

 

9.                  Posting at Your Own Risk.

(a)    Notwithstanding anything to the contrary, any Information entered by you while using the Website is at your own risk.
